UNIT – I :
Q. No. 1. (a) Democracy thrives in transparency, but not in secrecy. Discuss.
The right to know is the outcome of judicial activism. Explain.
(b) Write a note on Freedom of Information Act, 2002. Marks : 5
Supreme Court on right to information.

UNIT – II :
Q. No. 2. (a) Examine the procedure to get information and the obligation of the Public Authorities to provide information. Marks : 15 OR
What are the informations exempted from disclosure ? Refer to cases.

(b) Identify the bottlenecks in the implementation of RTI Act, 2005. Marks : 5 OR
‘The RTI is not only a tool for grievance redressal”. Explain.

UNIT – III :
Q. No. 3. (a) Explain the constitution and powers of the Central Information Commission. Marks : 15 OR
Explain the procedure relating to Appeals and Penalties provided under the Right to Information Act, 2005.

(b) Write a note on file notings. Marks : 5 OR
A State Govt. appointed a sitting MLA as State Chief Information Commissioner. Is it valid ?

UNIT – IV :
Q. No. 4. (a) Explain the salient features of Public Records Act, 1993. State the Central Govt’s power to make rules under it. Marks : 15 OR
Discuss the appointment and powers of a Commission Constituted under the Commissions of Enquiry Act, 1952.

(b) State the punishments provided under Official Secrets Act, 1923. Marks : 5 OR
A research scholar of a University wants to use public records for his academic purpose. What is the procedure to access them under Public Record Rules, 1997 ?

UNIT – V :
Q. No. 5. (a) Discuss the leading cases decided by the Central Information Commission and State Information Commissions on Income Tax, Baks, Police and Revenue Departments. Marks : 15 OR
What is meant by Best Practices ? Quote some of them adopted by the Central Information Commission, State Information Commissions and Govts. for the effective implementation of RTI, Act.

(b) An applicant filed an RTI application before BSNL seeking details of the SIM cards issued by it to its subscribers in a particular locality. Can it be provided ? Marks : 5 OR
Can a confidential report of an employee be disclosed ?

Give an account of right to information prior to the RTI Act, 2005.

State the relationship between RTI and Good Governance.

UNIT – II :
Q. No. 2. (a) What is voluntary disclosure ? State the obligation of the Public Authority to Provide Informations. Marks : 15 OR
Right to information is a general rule subject to the exemptions provided under the Act. Elucidate.

(b) An applicant filed an application before a public authority seeking some information. The Public Information officer demanded a proof of citizenship from the applicant. Advice the applicant. Marks : 5 OR

An RTI application was filed before a Housing Co-operative Society for seeking some information. The society argued that it is not a public authority. Decide.

UNIT – III :
Q. No. 3. (a) Distinguish complaint from Appeal. Examine the power of the Information commission to entertain complaint and appeal under the Act. Marks : 15 OR
Discuss the provisions relating to Constitution of Information Commissions and state the procedures provided for the removal of Information commissioners.

(b) An applicant in his application sought reply from the Public Information officer of a Public Authority, why a librarian post in his department was lying vacant for the last 10 years. Is Public information officer bound to provide such information ? Marks : 5 OR

An applicant in his complaint requested the commission to impose Penalty on a public information officer for not transferring his application before the appropriate PIO under Section 6(3) of the Act. Is it valid ?

UNIT – IV :
Q. No. 4. (a) The Right to Information Act, 2005 is the reformed version of the Freedom of Information Act 2002. Examine. Marks : 15 OR
Explain the salient features of the commission of Enquiry Act 1952 and discuss its powers.

(b) Write a note on ‘Record Officer’. Marks : 5 OR
What are the punishments provided under the Official Secrets Act 1923 ?

UNIT – V :
Q. No. 5. (a) All the Best Practices adopted by the Government, Information Commissions and Public Authorities are the good efforts to strenghten the RTI Act. Elucidate. Marks : 15 OR
State some of the leading cases decided by the State Information Commission of Police, Revenue, PWD and Irrigation departments.
