Instruction

1) The question paper has been divided into three parts, “A”, “B” and “C”. The number of questions to be attempted and their marks are indicated in each part.
2) Medium of question paper is “English / Gujarati”. Write in the language preference given by you.

3) Answer to all questions of each part should be written continuously in the script and should not be mixed with those of other parts. In the event of candidate writing answers to question in a part different to the one to each the question belongs, the question shall not be assessed by examiner.

4) The candidate should write the answer within the limit of words prescribed in the parts “A”, “B” and “C”.
5) Answer should be written in a one of the two languages. Answer should not be written in both the languages in the same paper.

Part – A

011. List any four general defences which negate tortious liability.

2) Attempt all 12 questions.
3) Each question carries 5 marks.
4) Answer should be given approximately in 50 to 60 words.

021. Explain legislation and precedent as source of law. Discuss the advantages of legislation over precedent.
022. Critically evaluate “The Lokpal and Lokayuktas Act, 2013”.

023. ”The fundamental rights and the directive principles constitute the conscience of the constitution ………” ”There is no antithesis between the fundamental rights and the directive principles …………….. and one supplements the other”. Discuss the relationship between fundamental rights and directive principles of state policy in the light of the said statement.

024. Explain the elements of fraud. Does silence amounts to fraud?
025. Discuss the various kinds of Mortgages.
026. Discuss as to when the ‘Doctrine of pith and substance’ is applied in relation to the distribution of the legislative powers.

027. In the Law of Torts, what are the consequences of Defamation of Public officials?
028. Elucidate the principles relating to ‘reasonable restrictions’ under Article 19(2) of the Indian Constitution.
029. Elaborate the ingredients of ‘Dowry Death’ with the help of relevant case law.

Part – C

3) Each question carries 20 marks.
4) Answer should be given approximately in 200 words.

033. Critically evaluate Austin’s theory of law – ‘Law is a command of the sovereign’. Do you agree that all laws cannot be a command. Discuss the same with suitable examples.

034. a) Discuss the meaning and importance of delegated legislation. What are the safeguards to control its misuse?
b) With the help of decided cases explain the principles of Natural Justice.

035. How has the Indian Constitution safe guarded the independence of the judiciary? Explain the same with the help of the constitutional provisions and the Supreme Court Judgements.

036. a) What is meant by ‘Frustration of Contract’? With the help of the decided cases discuss the Indian law on the said subject.

b) Who is a surety? Discuss the liabilities of a surety explaining the circumstances under which he stands discharged.

037. Discuss, citing relevant judicial pronouncements, the expanding horizons of Article 21 of the Indian constitution.

038. a) Discuss the powers of the Executive Magistrate for maintenance of public order and tranquility in case of:
i) unlawful assembly
ii) public nuisances
iii) ur gent cases of nuisance or apprehended danger under the code of Criminal Procedure, 1973.

b) Citing relevant cases, elaborate the difference between ‘unlawful assembly and rioting’

039. Discuss the proper and improper grounds for the application of Article 356 of the constitution of India.
